Allen is a full-time employee at Acme Community College. Among his various responsibilities is greeting the various tourist groups from other states that visit the campus. (Its lush gardens make Acme a popular sight-seeing venue.) Before one such group, Allen makes reference to an occupational program at Acme that leads to a business certificate. Allen informs the group that “anyone who completes this certificate program will immediately be qualified to work as an accountant for small businesses.” In fact, the state regulates the accountancy profession, and requires that anyone seeking certification as an accountant hold a bachelor’s degree. Allen is not concerned, however, as the visitors have no interest in attending Acme. Does Acme face responsibility for misrepresentations to people who almost certainly will never be Acme students?
