Bonnie, a representative of Acme Community College, knows that a brand new occupational program will be offered at Acme next fall. During a telephone conversation in July, she informs Chuck, a prospective student who lives in another state, about the program. She also tells him that she is “positive” that students enrolled in the program will be eligible to receive Title IV Federal Financial Aid. Unfortunately, Bonnie’s statement is incorrect. The US Department of Education has denied this program eligibility to participate in Title IV Federal Financial Aid; however, Acme nevertheless plans to offer it anyway. While Bonnie did not intend to deceive him, Chuck quits his job, moves hundreds of miles to an apartment near the Acme campus, and incurs thousands of dollars in debt. Would the fact that Bonnie did not intend to deceive Chuck excuse Acme from her misrepresentation?
